Please go through these terms and conditions (“Terms”) prior to accessing and using this website www.buildd.in By registering, accessing or otherwise continuing to browse and use the Website, you hereby irrevocably and unconditionally agree to comply with, abide by and be bound by all these obligations as stipulated in these Terms. These Terms are published in compliance with and shall be governed by Indian laws, including but not limited to (i) The Indian Contract Act, 1872; (ii) The Information Technology Act, 2000, the rules, regulations, guidelines and clarifications framed thereunder including the Information Technology (Reasonable Security Practices And Procedures And Sensitive Personal Information) Rules, 2011, and the provisions of rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011; (iii) Reserve Bank of India Act, 1934 and the applicable rules, regulations and guidelines made thereunder.
These Terms are electronic record in the form of an electronic contract formed under Information Technology Act, 2000 and rules made thereunder and the amended provisions pertaining to electronic documents / records in various statutes as amended by the Information Technology Act, 2000. These Terms do not require any physical, electronic or digital signature. These Terms constitute a legally binding document between You and Buildd (terms defined below). This document will be effective upon your acceptance of the same (in electronic form or by means of an electronic record or other means). Your access to and use of the Website and the Buildd Services (defined below) are always conditional upon your acceptance of and continuous compliance with these Terms and any other terms and conditions on the Website. Buildd reserves the right to modify these Terms at any time without prior notice. The User is expected to keep himself/ herself updated of any changes made in these Terms and Buildd undertakes no responsibility about advising/intimating the User about any such changes.
1. Definitions
“You/Your”, “Customer” or “User” will mean any natural or legal person who has registered with Buildd and who has accepted these Terms.
“Lending Partner” will mean any Non-Banking Financial Institution (NBFC) and/or any
other bank /financial institution partners of Buildd.“Buildd” will mean Quantastart Technologies Private Limited.
“Loan” will mean various lending products offered by Lending Partner through Buildd
to the Customer on the terms and conditions agreed with the Customer.“Loan Agreement/Sanction Letter” will refer to the terms and conditions governing the Loan and is applicable to the Customer and the Lending Partner.
2. Buildd Services
You understand and agree that Buildd is only the facilitator of the Loan(s) provided by the Lending Partner through the Website. Buildd helps Customers apply for the Loan(s) and facilitates the Loan processing on the Website and provides other support services to the Customers on the Website (“Buildd Services”).
3. Registration of Customer
Before using the Buildd Services and applying for the Loan(s), Customer shall register itself on the Website and provide all the accurate and correct information to Buildd. It will be the sole responsibility of the Customer to maintain the confidentiality of the username and password and not disclose the same to any third party and shall take all possible care to prevent unauthorized disclosure of the username or password.
4. Application for Loans
Customer will submit the application form and provide all relevant information and documents at the time of application for the Loan on the Website. Buildd will not process any incomplete or defective application forms received from Customer. Buildd will not be liable for any loss or delay caused to Customers due to such incomplete or defective application forms. Customer agrees that submission of Loan application to Buildd does not imply automatic approval. The Lending Partner will decide the quantum of the Loan at its sole and absolute discretion.
5. Loan Agreement
On acceptance of the Loan application by the Lending Partner, the Customer will execute the Loan Agreement with the Lending Partner. Customer understands and agrees that since the Loan is provided by the Lending Partner, Buildd will not be a party to any dispute which arises between the Customer and Lending Partner pursuant to the Loan Agreement.
6. Customer Consents
Customer agrees and acknowledges that for availing the Buildd Services:
Customer hereby gives Buildd the right to disclose any information relating to Customer including but not limited to Customer’s personal information to the Lending Partner, Credit Information Bureau of India (CIBIL) and/or any other governmental entity or any third party for KYC information verification, credit risk analysis, or for other related purposes. Customer agrees that all information provided to Buildd upon registration and at the time of availing the Loan and at all other times will be true, accurate, current and complete.
Buildd may communicate with Customer either by phone calls, SMS, WhatsApp, electronic mails or through any other mode of communication available for the purpose of sending or discussing the current status of Customer’s Loan(s), account activity or reminder/ collection of any dues in respect of any Loan or for any matter related to the Loan(s) and such phone calls, SMS, etc., shall not be covered under the purview of “Do Not Disturb” policy of the Telecom Regulatory Authority of India (TRAI).
Customer hereby gives its consent to Buildd for providing e-NACH Mandate for repayment of Loan from its account. Customer shall ensure availability of funds in the account on which such e-NACH Mandate/ have been drawn and that the Customers will not at any time close its account before the complete repayment of the Loan or issue any instruction to its bank which will prevent the repayment of the Loan.
7. Customer hereby represents and warrants that
All information, data, documents provided by it to Buildd are complete, true and accurate.
Customer will not breach any applicable laws while availing the Buildd Services and
availing Loans through the Website.Customer will not use the Website to track or collect personal information of other users.
Customer will not interfere with or circumvent the security features of the Website.
8. Disclaimer of warranties
Buildd provides the Buildd Services on an “as-is” basis and makes no representations about the timeliness, suitability, reliability, availability, of the Buildd Services.
Buildd, at no event, be liable/ responsible for any direct, indirect, punitive, incidental, special, consequential damages or any damages for the delay or inability to use the Website, or failure to provide Buildd Services, or for any information, date, statement, certificate, software, and any other services obtained through the Websites, or otherwise arising out of the use of Website.
Buildd reserves the right to suspend Customer’s access to Website if in Buildd’s opinion security of the Website or of the data could be compromised or in case of breach of these Terms or any other terms and conditions mentioned on the Website.
